Terms and Conditions – GOTOVIAR B.V.
By using our Services, you agree to these Terms and Conditions, which may be updated from time to time. Continued use of the Services constitutes your acceptance of any such changes. If you do not agree to these terms, you are not permitted to use the Services.
These Terms and Conditions apply to all of our services and form an integral part of any agreement entered into with the User.
These Terms and Conditions are available upon request, either electronically or by other means.
License
1.1. We grant you a non-exclusive, non-transferable license to use our Service for personal or commercial purposes.
1.2. You may not use our Service for any unlawful or unauthorized purpose.
1.3. You may not copy, modify, distribute, sell, or transfer any part of our Service without prior written permission from us.
Payment
2.1. Payment for our Service is due at the time of purchase.
2.2. We accept payments via electronic bank transfer or other payment methods we may provide from time to time.
2.3. All prices are listed in euros, exclusive of VAT, and are subject to change without prior notice.
2.4. You represent and warrant that you have the legal right to use any bank account or credit card used to pay for GOTOVIAR services.
2.5. You are also responsible for paying any applicable taxes related to your purchases.
2.6. Verification of purchase-related information may be required prior to accepting any order.
2.7. If you have any questions or issues related to electronic transactions, contact info@gotoviar.com.
Delivery
3.1. Our Service is delivered electronically via download from our website, through our data server, or by email.
3.2. We will make commercially reasonable efforts to deliver the service promptly after receiving your payment.
3.3. We are not responsible for any delay or failure in delivery caused by circumstances beyond our control.
3.4. We reserve the right, at our sole discretion, to release updates that introduce new, modified, or removed functionalities/graphic elements within the software. If the core functional features of the software are minimally affected, the User does not need to be informed in advance.
3.5. We may temporarily suspend the software for (emergency) maintenance. If possible, we will notify the User in advance and aim to schedule maintenance at the least disruptive time.
3.6. In the event of force majeure, our obligations under the subscription are suspended in whole or in part for the duration of the force majeure.
3.7. Force majeure includes, but is not limited to: government measures; failures in internet, computer network or telecommunications facilities; personnel issues; strikes; general transportation problems; and deficiencies or delays in availability of products/services from suppliers, including hosting providers, ISPs, and (open source) software vendors.
Security and Privacy
4.1. We make efforts using both hardware and software to protect the software and uploaded data/designs against misuse and unauthorized access to user data.
4.2. We also strive to keep the software up to date regarding security aspects. However, we do not guarantee that information security will be effective under all circumstances.
4.3. Upon termination of the subscription, we will delete or return (at the User’s choice) all personal data, unless legal retention requirements apply.
Warranty
5.1. We warrant that our Service corresponds with the accompanying documentation.
5.2. We do not warrant that our Service will be error-free or that any defects will be corrected.
5.3. Our Service is provided “as is,” without any warranties, express or implied.
Intellectual Property
6.1. Our Service is protected by copyright, trademark, and other intellectual property rights.
6.2. You may not use any of our trademarks or service marks without prior written consent.
6.3. You may not reverse-engineer, decompile, or disassemble any part of our Service.
Indemnification
7.1. You agree to indemnify, defend, and hold us harmless from all claims, damages, liabilities, and costs, including reasonable attorneys’ fees, arising from your use of our Service.
7.2. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses.
Limitation of Liability
8.1. Under no circumstances shall we be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to the use of our Service.
8.2. We are not liable for accidents, motion sickness, seizures, eye strain, disorientation, or injuries that may occur during the use of our products or services.
8.3. We are not liable for consequential damages, lost profits, lost revenue or savings, loss of goodwill, business interruption, customer claims, data corruption, data loss, or inaccurate data representation.
8.4. Furthermore, we are not liable for damage caused by actions or omissions of our suppliers, including hosting providers, resellers, and (open source) software providers we engage.
8.5. Our liability is limited to the amount you paid for our Service.
Miscellaneous
9.1. We reserve the right to modify and/or supplement these terms and conditions periodically. Users accept such changes by continuing to use the software and services after modifications are made.
9.2. If any provision of these Terms is found to be void, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
9.3. The invalid provision shall be replaced by a valid one with similar legal and economic effect.
9.4. These Terms and Conditions are governed exclusively by the laws of the Netherlands.
9.5. All disputes arising from or related to these Terms and Conditions shall be submitted exclusively to the competent court in Zeeland-West-Brabant, the Netherlands.
These Terms and Conditions became effective in May 2025.
